1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of https://fuelforwardfoundation.org and any related pages, forms, donation features, event registrations, program applications, communications, and services operated by Fuel Forward Foundation (“we,” “us,” or “our”).
By accessing or using our website or submitting information through our services, you agree to these Terms. If you do not agree, do not use the website or services.
2. Eligibility and Acceptable Use
You may use our website only for lawful purposes and in accordance with these Terms.
If you are under the age of majority where you live, you may use donation, registration, purchase, or application features only with the involvement and permission of a parent or legal guardian. Certain events, programs, or activities may have additional eligibility requirements.
3. Our Mission and Website Information
Fuel Forward Foundation provides charitable programs and information concerning emergency fuel relief, disaster response, veterans, first responders, community support, events, and related initiatives.
Website content is provided for general informational purposes. It is not emergency response, legal, tax, financial, medical, safety, or other professional advice.
Fuel Forward Foundation is not an emergency service. If you are experiencing an immediate emergency, call 911 or contact the appropriate local authorities.
Information about planned response activities, available resources, service areas, schedules, partners, or program availability may change based on safety, funding, weather, access, fuel supply, government directives, and operational conditions.
4. Donations
Donations are voluntary. Unless otherwise stated at the time of donation or required by law:
- Donations are generally nonrefundable once processed.
- Fuel Forward Foundation may use unrestricted donations where they are most needed to advance its charitable mission.
- When a donor expresses a preference for a particular program, event, disaster, community, or purpose, Fuel Forward Foundation will make reasonable efforts to honor that preference but retains discretion to redirect funds if the stated purpose has been fulfilled, becomes impracticable, or additional needs arise.
- A donation does not create an ownership interest, membership interest, right to control operations, or entitlement to goods or services unless expressly stated.
Fuel Forward Foundation does not provide tax advice and does not guarantee that any payment qualifies for a charitable deduction. Deductibility depends on Fuel Forward Foundation’s tax-exempt status at the time of the contribution, the nature of the payment, and the donor’s individual circumstances. Donors should retain applicable receipts and consult their own tax advisers.
If you believe a donation was submitted in error or without authorization, contact Fuel Forward Foundation promptly. Refund requests will be reviewed individually and may be granted when required by law or at the discretion of Fuel Forward Foundation, subject to processing limitations and any benefits already provided.
5. Event Registrations, Tickets, and Sponsorships
Event details, ticket terms, sponsorship benefits, refund rules, age restrictions, alcohol policies, and participation requirements may be provided on the applicable event or registration page. Those additional terms are incorporated into these Terms.
- Tickets, registrations, and sponsorship payments are nonrefundable unless the applicable event terms state otherwise, the event is canceled without an offered substitute, or a refund is required by law.
- Fuel Forward Foundation may reschedule, relocate, modify, or cancel an event for safety, weather, venue, operational, legal, or other reasonable reasons.
- Admission may be denied or revoked for unsafe, disruptive, unlawful, or inappropriate conduct.
- Alcohol may be possessed or consumed only by persons age 21 or older and only in compliance with venue rules and applicable law. Fuel Forward Foundation and its vendors may refuse service.
- Sponsors may not imply endorsement beyond the specific sponsorship relationship or use the Fuel Forward Foundation name, logos, or materials without written approval.
- Unless expressly stated, third-party travel, lodging, transportation, parking, and incidental expenses are not included and remain the participant’s responsibility.
6. Volunteers and Participants
Volunteer opportunities and field activities may require separate applications, waivers, releases, training, background checks, safety requirements, confidentiality obligations, or codes of conduct.
Participation is not guaranteed. Fuel Forward Foundation may accept, decline, reassign, suspend, or end volunteer participation based on program needs, qualifications, conduct, safety, or applicable requirements.
Volunteers and participants must follow all safety instructions, laws, venue rules, and directions from authorized personnel. No person may handle, transport, dispense, or work around fuel or regulated materials unless specifically authorized, properly trained, appropriately licensed where required, and covered by the applicable operating and insurance arrangements.
7. Programs, Awards, and Applications
Programs such as the Red, White & Fuel Veteran Franchise Award are governed by separate official rules, eligibility requirements, disclosures, application procedures, judging criteria, deadlines, and participation agreements. If those terms conflict with these Terms, the program-specific terms control.
Submitting an application does not guarantee eligibility, finalist status, an interview, an award, funding, travel reimbursement, a franchise, business success, or any other benefit.
Fuel Forward Foundation may:
- Verify information and request supporting documentation.
- Conduct appropriate due diligence.
- Disqualify incomplete, inaccurate, misleading, or unverifiable submissions.
- Modify nonmaterial program procedures.
- Suspend or cancel a program when permitted by the applicable rules and law.
Applicants are responsible for the accuracy of their submissions and for redacting Social Security numbers and other sensitive information not specifically requested.
Franchise-related information is subject to applicable franchise laws, the current Franchise Disclosure Document, and separate agreements. Nothing on the Fuel Forward Foundation website constitutes an offer to sell a franchise.
8. Purchases and Third-Party Shops
Merchandise or other products may be offered through third-party websites or service providers. Their terms, privacy policies, shipping rules, return policies, warranties, and customer-service procedures govern those transactions unless Fuel Forward Foundation expressly states otherwise.
A link to a third-party shop does not make Fuel Forward Foundation responsible for that provider’s products, services, security, availability, or performance.
9. Accounts, Forms, and Accurate Information
You agree to provide current, accurate, and complete information and to update it when necessary.
You may not:
- Impersonate another person.
- Submit information without authorization.
- Create fraudulent transactions.
- Manipulate an application or judging process.
- Interfere with website security or operation.
You are responsible for maintaining the confidentiality of any access credentials associated with a third-party service used to interact with Fuel Forward Foundation.
10. Prohibited Conduct
You may not:
- Use the website or services for unlawful, fraudulent, abusive, deceptive, harassing, or harmful purposes.
- Attempt to gain unauthorized access to systems, accounts, applications, records, or personal information.
- Introduce malware, scrape or harvest information without authorization, overload the website, or bypass access or security controls.
- Misrepresent an affiliation with Fuel Forward Foundation, its programs, Juiced Fuel, donors, sponsors, partners, or any government or emergency-response organization.
- Copy, modify, distribute, sell, or commercially exploit website content except as permitted by law or written authorization.
- Use the Fuel Forward Foundation name, logo, photographs, program names, or other materials in a manner that is misleading, defamatory, or likely to cause confusion.
11. Intellectual Property
The website and its content, including text, graphics, logos, program names, photographs, videos, designs, and other materials, are owned by or licensed to Fuel Forward Foundation and are protected by applicable intellectual-property laws.
Fuel Forward Foundation grants you a limited, revocable, nonexclusive, nontransferable license to access and use the website for personal, informational, and lawful charitable-engagement purposes.
Fuel Forward Foundation, Red, White & Fuel, and related names and marks may be protected trademarks or service marks. No license to use any name or mark is granted except with prior written authorization from Fuel Forward Foundation.
12. User Submissions
If you submit photographs, videos, testimonials, stories, comments, or other content for publication or promotional use, you represent that you have the right to provide it and that it does not violate another person’s rights.
Any permission to use submitted content will be governed by the consent, release, program rules, or submission terms presented at the time of collection.
Fuel Forward Foundation will not use private application materials publicly merely because they were submitted through a form.
13. Privacy
The collection and use of personal information by Fuel Forward Foundation are described in the Fuel Forward Foundation Privacy Policy.
By using the website or services, you acknowledge that information may be processed as described in that policy and in any additional notice presented at the time of collection.
14. Third-Party Links and Services
The website may contain links to payment processors, event platforms, application portals, social media sites, shops, partner organizations, government resources, and other third-party services.
Fuel Forward Foundation does not control and is not responsible for third-party content, availability, privacy, security, terms, or practices. Use of third-party services is at your discretion and subject to their terms.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
FUEL FORWARD FOUNDATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
FUEL FORWARD FOUNDATION DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Fuel Forward Foundation does not guarantee that donations will produce a particular result, that fuel or relief will be available in every location or emergency, or that any applicant, volunteer, sponsor, donor, or participant will receive a particular opportunity, benefit, recognition, or outcome.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUEL FORWARD FOUNDATION AND ITS DIRECTORS, OFFICERS, VOLUNTEERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OPPORTUNITY, OR GOODWILL ARISING FROM OR RELATED TO THE WEBSITE OR ONLINE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FUEL FORWARD FOUNDATION FOR A CLAIM ARISING FROM THE WEBSITE OR ONLINE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO FUEL FORWARD FOUNDATION FOR THE TRANSACTION GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100).
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be excluded.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fuel Forward Foundation and its directors, officers, volunteers, employees, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your unlawful use of the website or services.
- Your violation of these Terms.
- Your infringement of another person’s rights.
- Information or content you submit without authority.
This section does not apply to the extent a claim results from the conduct of Fuel Forward Foundation and cannot lawfully be shifted to you.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or the website must be brought in a state or federal court located in Charleston County, South Carolina. The parties consent to the jurisdiction and venue of those courts.
Before filing a legal action, you and Fuel Forward Foundation agree to make a reasonable good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution.
This requirement does not prevent either party from seeking urgent injunctive or equitable relief.
19. Changes, Suspension, and Termination
Fuel Forward Foundation may update these Terms by posting a revised version with a new effective or updated date. Your continued use after the revised Terms become effective constitutes acceptance of the changes.
Fuel Forward Foundation may modify, suspend, restrict, or discontinue any part of the website or services at any time, subject to applicable law and any separate written agreement.
20. General Terms
These Terms, together with the Fuel Forward Foundation Privacy Policy and any applicable event, program, sponsorship, donation, waiver, or transaction-specific terms, constitute the agreement governing your use of the website and services.
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.
The failure of Fuel Forward Foundation to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without written consent from Fuel Forward Foundation. Section headings are provided for convenience only.
